After multiple attempts, North Carolina finally legalized online sports betting in June 2023, and eight sportsbooks launched March 11, 2024.
While in-person sports betting was already legal at the state’s tribal casinos, the new law paved the way for the expansion of online sports betting. The law also allows for more retail sportsbooks to open in NC.
Tax revenue from North Carolina’s expanded sports betting will be used to support the state’s General Fund, the new Major Events, Games, and Attractions Fund, and athletic departments at 13 public universities in the UNC system, including five HBCUs (Historically Black Colleges and Universities).
Here’s an overview of NC’s new sports betting legislation and what it contains, including details regarding how North Carolina is allocating tax revenue produced by the new NC online sports betting sites.
North Carolina sports betting bill
After North Carolina lawmakers almost passed an online sports betting bill in 2022 (missing by just a single vote), new legislation proposed at the start of the 2023-24 session resulted in the bill’s passage.
HB 347, titled Sports Wagering/Horse Race Wagering, was passed in the House by a 64-45 vote in March 2023. It then moved through multiple Senate committees before the full Senate approved it by a 37-11 margin. On June 14, 2023, Gov. Roy Cooper signed the bill into law. The bill outlined that online sports betting could not launch before Jan. 8, 2024, but had to go live within one year (i.e., by June 14, 2024).
Before the bill passed, the tax rate on revenue from online sports betting was increased from 14% to 18%. The bill additionally provides for eight new retail sportsbooks to open at professional sports venues across the state and authorized licensing for pari-mutuel wagering on horse races.
HB 347 charges the North Carolina Education Lottery (NCEL) with regulation of commercial sports betting in the state. After it was passed, the NCEL spent the following months hammering out rules and regulations while the state legislature also made additional adjustments to the law as part of the fall budget process. These changes resulted in the maximum number of commercial online sports betting licenses available being reduced from 12 to 11, with the two NC tribes also eligible to offer online sports betting thanks to their tribal-state compacts.
Also, those latter changes forced operators seeking to launch sportsbook apps in NC to partner with one of the state’s professional sports franchises, venues, or the PGA Tour or NASCAR. An operator has to enter written designation agreements with one of the 11 eligible entities in order to receive an online sports betting license. An interactive sports wagering operator license requires a $1 million fee (due when applying), and licenses will need to be renewed every five years.
Here are some of the details from NC’s new expanded sports betting law.
Launch date March 11, 2024 Legal betting age 21 Number of mobile licenses available 11 commercial, 2 tribal Tax rate on operators 18% of gross gaming revenue Tax rate on winnings 5.25% College sports betting allowed? Yes, including on North Carolina schools Credit card deposits allowed? Yes
North Carolina sports betting tax rate
As noted, NC online sportsbook operators pay an 18% tax on gross gaming revenue (GGR). That means all the money the sites generate from people placing wagers, sometimes called the “gaming win,” is subject to the tax. GGR is calculated by subtracting the amount bettors win from the amount they wagered.
It’s worth noting that the NC law specifically disallows operators from deducting promotional spending from their GGR. That’s not the case in every state, but this stipulation ensures that all the revenue the sites earn in North Carolina will be taxed at that 18% rate.
How does the tax rate on revenue in NC compare to those of neighboring states with legal online sports betting? Virginia legalized online sports betting in 2020 and launched in 2021, and operators there pay a 15% rate on revenue. In Virginia, operators were able to deduct promotional expenses at first, but that is no longer the case.
Meanwhile, Tennessee legalized online sports betting in 2019, with the first sites going live in 2020. There, the revenue tax started at 20% (with no promotion deductions), but in July 2023, the state passed new legislation to change how it taxes online sports betting GGR. Now, Tennessee taxes 1.85% of the sports betting handle or total amount wagered. Tennessee is still monitoring how the change has affected tax revenue.
Looking at other states of comparable size to North Carolina that have legalized online sports betting, NC’s tax rate is much higher than, say, **Michigan’**s. In the Wolverine State, it’s a 9.65% tax for tribal casinos, with commercial casinos paying an additional 1.25%. NC’s rate was higher than Ohio’s as well. There, the rate was 10%, but in July 2023, Ohio doubled its rate to 20%.
Projected North Carolina sports betting tax revenue
Tax revenue projections were a big factor in NC lawmakers’ debates over the new law. A legislative fiscal note produced by the NC General Assembly before the bill’s passage attempted to predict the fiscal impact of HB 347.
The projections suggest North Carolina will enjoy $64.6 million in estimated tax revenue during the first year of expanded sports betting in the state, increasing each year thereafter to reach $100.6 million by the fourth year.
How will NC sports betting tax revenue be used?
North Carolina’s new expanded sports betting law establishes exactly how the tax revenue generated by the new sportsbooks will be used. Here is an overview of how that money will be distributed.
Responsible gambling ($2 million)
The new law allocates $2 million of North Carolina’s sports betting tax revenue to fund the North Carolina Problem Gambling Program. The program is run by the North Carolina Department of Health and Human Services and is funded by the NCEL. The program oversees several different gambling assistance programs and educational modules.
Youth sports ($1 million)
Another $1 million of sports betting tax revenue each year will go to North Carolina Amateur Sports to help fund and grow youth sports leagues and facilities. That money will also be used to buy equipment and support programs designed to help more young people in North Carolina participate in sports.
University athletic departments ($300,000 each)
The University of North Carolina system includes 17 universities, 13 of which will receive $300,000 annually from the new sports betting tax revenue to help fund their athletic departments. The selected schools include all five of the HBCUs in the UNC system. The university athletic departments slated to receive the funding are at the following schools:
- Appalachian State University
- East Carolina University
- Elizabeth State University
- Fayetteville State University
- North Carolina A&T State University
- North Carolina Central University
- University of North Carolina at Asheville
- University of North Carolina at Charlotte
- University of North Carolina at Greensboro
- University of North Carolina at Pembroke
- University of North Carolina at Wilmington
- Western Carolina University
- Winston-Salem State University
North Carolina Youth Outdoor Engagement Commission grants ($1 million)
Another $1 million each year will go to the North Carolina Heritage Advisory Council for grants to help the state’s sports teams with travel expenses and to help the state attract sporting events for amateur athletes. A new commission, called the North Carolina Youth Outdoor Engagement Commission, is being formed to administer these funds.
Remaining proceeds
After those payments are all met, the remaining sports betting tax revenue will be divided up and distributed as follows:
- 50% for the North Carolina General Fund
- 30% for the North Carolina Major Events, Games, and Attractions Fund
- 20% to be equally distributed to the 13 university athletics departments listed above
As you can see, a significant amount of the new sports betting tax revenue in North Carolina will be used to support athletics in the state at all levels.
Taxes on North Carolina sports betting winnings
Those who win money betting on sports in North Carolina face a 5.25% tax on their winnings, much as they do when they win money playing the North Carolina Education Lottery. Like many other states, NC considers gambling winnings taxable income and applies the same 5.25% flat tax rate on sports betting winnings.
Some states do not tax gambling winnings. Tennessee, for example, does not, although there you do have to pay federal income tax on gambling winnings, just like you also have to do in North Carolina.
Be aware that the tax obligation on gambling winnings in NC applies whether or not any taxes are withheld at the time you collect your winnings. For example, online sportsbooks will typically withhold federal taxes on winnings of $5,000 or more. Regardless of whether they do, players who win money betting on sports in NC will still be obligated to pay both state and federal income tax on their winnings.
