The utility did call the N.C. Emergency Management Center that night, but state officials say the urgency wasn’t made clear. Duke disagrees.

When did we know?

Three hours before the ash plume arrived there, Danville’s water plant operator knew a threat existed and began monitoring his equipment accordingly.

It was a textbook response.

But not so in North Carolina where something much more cumbersome played out in the first 12 hours after the spill.

A potential public threat

"Whether or not consumers of drinking water live in another state is irrelevant. If an incident has a potential public threat, we will take action.” — Julia Jarema, N.C. Department of Public Safety

The law

Duke Energy did not break any laws in failing to alert North Carolina environmental officials more quickly. State law requires the person or company responsible for a spill to report it to state officials within 24 hours and to issue a press release about the incident within two days.
