More than 1,000 gay and lesbian couples who married in Utah after the state same-sex marriage ban was overturned could get benefits in late July 2014 following a favorable ruling from a federal appeals court. On Friday, July 11, 2014, the 10th Circuit denied Utah’s request for an indefinite delay. Instead, justices gave them only until July 21 to ask the U.S. Supreme Court to weigh in.

GAY MARRIAGE Q&A

Q. What did the U.S. Court of Appeals for the 4th Circuit in Richmond, Va., do on Monday?

A. A three-judge panel ruled 2-1 that Virginia’s constitutional ban on same-sex marriage, enacted in 2006, is unconstitutional.

Q. What case did the 4th Circuit Court of Appeals rule on?

A. Bostic v. Schaefer. The original lawsuit was brought last year by two same-sex couples, Timothy Bostic and Tony London, and Carol Schall and Mary Townley.

Bostic and London decided to sue after they were denied a marriage license in Norfolk, Va.

Schall and Townley were married in California in 2008 and are trying to get their marriage recognized in Virginia, where they now live.

Q. What happens now?

A. If no one challenges the 4th Circuit’s decision, it will take effect in 21 days in Virginia. However, defendants in the lawsuit can ask for an en banc review, which means all the 4th Circuit Court judges would hear the case and not just the three-judge panel that issued Monday’s ruling. They can also ask the U.S. Supreme Court to review it.

In either case, a stay would be issued.

“If the Supreme Court heard the case, they could potentially touch the issue of whether state marriage bans are constitutional,” said Chris Brook, who serves as legal director for the ACLU of North Carolina. “Or they can choose not to hear the case and allow marriages to proceed in Virginia.”

Q. If the decision does stand, what happens in North Carolina?

A. Though North Carolina is in the 4th Circuit, the court’s decision does not mean that same-sex marriages can occur in North Carolina. However, if the court’s decision does stand, defending the state’s gay marriage ban would become increasingly difficult, Brook said.

“The ruling directly impacts only Virginia’s same-sex marriage ban,” he said. “But the legal logic supporting the decision puts the writing on the wall for Amendment One (the law banning same-sex marriage in North Carolina).”
